Terms of Service

1. Who can use FIC

You must be at least 18 years old and able to form a binding contract under Indian law to use FIC. You sign in with a Google account; you're responsible for keeping that account secure and for all activity under your FIC profile. We don't independently verify age or identity beyond what Google provides at sign-in.

2. What FIC is, and isn't

FIC is a community and discovery platform. We help freelancers and businesses find each other, and provide tools (contract templates, invoice generation, deal tracking) to help you manage that work. FIC is not a party to any engagement, contract, or payment between a freelancer and a business. We don't process payments, employ freelancers, or guarantee the outcome, quality, or legality of any work arranged through the platform. Contracts and invoices generated on FIC are templates for your own use; you're responsible for their accuracy, enforceability, and compliance with any tax or regulatory requirements that apply to you. Disputes between a freelancer and a business arising from their own engagement are between those parties. FIC is not obligated to mediate, arbitrate, or refund anything on either party's behalf.

3. Your content

You retain ownership of the content you submit: profile information, portfolio/work samples, job listings, showcase entries, and playbook contributions. By posting content, you grant FIC a non-exclusive, worldwide, royalty-free license to host, display, distribute, and promote it on the platform (e.g. showing your profile in the directory, or a showcase entry on the homepage). This license ends when you delete the content or your account, except for copies already shared with other users as part of normal platform operation (e.g. an application already sent to an employer). You're responsible for making sure you have the right to share anything you post, and that it doesn't infringe anyone else's rights.

4. Directory listings, jobs, and showcase submissions

Talent directory listings, job postings, and showcase entries are reviewed by our admin team before becoming public, but review does not constitute an endorsement or guarantee of accuracy. We may reject, edit for clarity, suspend, or remove any listing or account at our discretion, including for content that's misleading, spam, or violates these Terms.

5. Cost

FIC is free to use today. Creating an account, posting jobs, applying to roles, listing your profile in the directory, and submitting to the showcase carry no charge. We may introduce paid plans or features in the future; if we do, we'll clearly say so before anything is charged, and using free features will never require payment retroactively.

6. Community channels

We run an optional WhatsApp community for members. Joining is voluntary and happens entirely on WhatsApp. Your use of that group is subject to WhatsApp's own terms and privacy policy, not just ours, and admission may be reviewed to keep the group high-trust.

7. Prohibited conduct

You agree not to:

• Impersonate another person or misrepresent your identity, skills, or business
• Post false, misleading, or fraudulent listings or reviews
• Use the platform to harass, discriminate against, or defraud another user
• Post content that infringes someone else's copyright, trademark, or other rights
• Scrape, resell, or bulk-extract directory or listing data without permission
• Attempt to circumvent security measures or access accounts that aren't yours
• Use the platform to send unsolicited bulk messages or spam other users

8. Intellectual property

The FIC name, logo, and site design are owned by us and may not be used without permission. If you believe content on FIC infringes your copyright, email hello@freelanceindia.club with (a) a description of the work you believe is infringed, (b) the URL of the infringing content on FIC, and (c) your contact details. We'll review and remove content that's confirmed to infringe.

9. Suspension and termination

We may suspend or terminate your account for violating these Terms, at our reasonable discretion. You can stop using FIC and request account deletion at any time by contacting us (see below).

10. Disclaimers and limitation of liability

FIC is provided "as is" without warranties of any kind. We don't guarantee uninterrupted or error-free service, and we're not liable for disputes, losses, or damages arising from engagements or transactions between users. To the maximum extent permitted by applicable law, FIC's total liability to you for any claim arising from your use of the platform is limited to ₹1,000 (or the amount you've paid us in the past 12 months, if greater). Since the platform is free to use today, this cap is nominal in practice, but forms our position going forward including if paid features launch.

11. Indemnification

You agree to defend and hold FIC harmless from any claim, loss, or damages (including reasonable legal fees) arising from your content, your violation of these Terms, or your engagement with another user of the platform.

12. Governing law

These Terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka.

13. General terms

If any part of these Terms is found unenforceable, the rest remains in effect. These Terms are the entire agreement between you and FIC regarding the platform, and supersede any earlier understanding on the same subject. We may assign these Terms in connection with a merger, acquisition, or sale of assets; you may not assign your account or these Terms to anyone else.

14. Changes to these Terms

We may update these Terms from time to time. We'll post the updated version here with a new "last updated" date; continued use of FIC after a change means you accept the updated Terms.
